Legal Question in Elder Law in Illinois

Mother/daughter estate conflict

(Aunt lives in Chicago and daughter in Virginia)

95-year-old aunt needs to live in an assisted living retirement arrangement because of short-term memory problems and instability in getting around.

Daughter's name is on home title and investments. Daughter resists selling home and having mother live in any retirement setting. Daughter resists having mother move in with her.

My aunt has the money to afford assisted living but the daughter is hoarding the money for herself.

We could have my aunt move in with us but our home isn't physically very elder-friendly (many stairs to deal with). Ahe would be happiest in an independent situation.

My aunt realizes all these things and resists going against her daughter's wishes. Though she does get upset about having to constantly feed her money.

Any options for my aunt? Would certainly like to avoid court.

Re: Mother/daughter estate conflict

If your cousin has had everything in her name for 5 years or more, your aunt is eligible for Medicare to pay for the nursing home. Call a nursing home and ask for an appointment with a counsellor. they will explain everything to you.
