Legal Question in Elder Law in Illinois

undue influence/punishment in courts

uncle had a will in 86 & 91 that split everything egual to remeaining heirs, one heir used undue influence to change the will and everything was left to her. we have documented prof that she lied about why will was changed.what was not redirected to her, she cashed out using P.O.A and put fund into account she put her name on. a year before uncle passed away she took all his personal property. When the courts rule the will was invalid, and I am sure they Will. Can the Judge order to eliminate the heir in question? her part will not even begin to cover the cost of having to fight everything.when the will was changed, uncle had sever health problems including Alzheimers. We are very comfortable with knowing the Will, is invalid. We just dont know how the courts may punish the personwho was commiting all the wrong doing.

Re: undue influence/punishment in courts

Hello. It is possible that the Court will contact the Office of the State's Attorney to look into the matter. From your posting, I am of the opinion that this relative may have violated the law. Will be happy

to discuss this with you further and in more detail.
