Legal Question in Entertainment Law in Illinois
Wedding Photography
Signed a contract for a photographer to do our wedding, but wish to cancel our contract due to quality of sample pictures. The contract does not have a cancellatin policy, therefore I sent a termination agreement for him to sign. However, he refuses to sign it. Since he has no contract policy on the contract, aren't I within my right to cancel? I provided him with a termination and I'm not sure what else I should do? Our wedding isn't until next May (& months) so there is ample warning. Thank You,

Re: Wedding Photography
Its not so simple. You signed a contract, so are bound by the terms of that contract. If there is no cancellation policy, the contract could simply be read as not allowing for cancellation.
With that said. If the quality of the work was such that you feel you signed the contract under false pretenses (e.g. he said he would allow you to cancel; he said he has experience shooting in black and white and has never done so, etc etc), then you might have a case.
If you want an attorney to have a look at your contract, please feel free to give us a call.

What you can do is governed by the terms of the contract you signed. You may very well be obligated to pay him as agreed.
A big question you are going to have to answer if you are going to fight this is why you didn't look at the photographer's samples BEFORE you signed the contract.
