Legal Question in Family Law in Illinois
IF you are 17 can you move out to live another parent?
My girlfriend is 17, she is six and a half months pregnant. Her mother recently moved her to Indiana which is three hours away from me. I was wondering if she can leave her mom and come back to Illinois to live with her father. Her father doesn't have full custody, he just has visitation rights. If you have any recommendations that my solve my problem please include them. Thank You, Robert.

At the age of seventeen, she can apply to the courts to become emancipated. Otherwise, her father can apply to the courts to get custody of her. Her opinion will come into play with the court although the decision will ultimately be based upon her best interests being served. I would suggest to you that you really look at what is in her best interests - her mom may be the best person to help her complete this pregnancy and/or care for the child after birth. Be sure this is the best thing for your girlfriend.
