when 2 people are divorced and need to sell the house to divide the money, does the person not residing in the house have legal access to the house before its sold?

Yes. However you need to be careful. If the person not residing in the home is a man, and the wife calls the cops and says he did anything to her, he can easily be arrested. Then she will file an emergency protective order and he will be ordered to stay away. Most women know this and it happens a lot. If the two people are amicable, then there is less of a problem.
