Legal Question in Family Law in Illinois

17 year old moving out of state

Her father has not seen her for 2 1/2 years. We are going to move to Arizona in one week, my wife has a transfer for her job, and I am retiring. The father now is trying to stop this move. What will happen in court. How will the judge rule.

Re: 17 year old moving out of state

If you (or your wife) have not consulted an attorney about this, it is probably a good idea. I think your wife would have a good chance of getting the move approved, however, many factors are looked at and Illinois requires court approval. The judge needs to be made aware of why the move is happening. The judge will look at what is best for the child, but typically moving for a job is allowed. There is just no way to say for sure that that is what will happen because the judge has discretion in his or her decision.
