Legal Question in Family Law in Illinois

4 year old in a poor environment
My husband has visitation with his son 2 days a week with overnight stays. We have no other children. Everytime the child comes to our home his hair, body, and clothes smell bad, and on occasion he is dirty. There have been times when he has talked about killing people, and has used other bad language etc (he was 3 years old at the time). Let me assure you that he doesn't learn that from our house. Recently my husband told me that when he went to pick up his son, his mother was having a house party at her home where there was a child between the ages of 10-12 smoking a cigarette. I know that we need to do something but his mother is the custodial parent and will not consider any other arrangement. What is our next step for my husband to seek primary custody of his son, before his life is ruined.
