Legal Question in Family Law in Illinois

I have a 2 1/2 year old son who has lived primarily with me for the past year. His mother has been involved in minimally since our split last March and is now pushing for our son to live with her but im not agreeing with the change. If i were to take this to court what are the chances of me obtaining full custody?

Hello. In my opinion, you have a good chance of getting custody. However, if you and the mother have never been married and you have not been legally declared the father of your child, you should file a parentage petition immediately. I am assuming you are in Illinois, but most states have a similar provision for the father to initiate parentage. The appropriate name for this petition is .......... a petition to establish the father and child relationship.
