I have a 12 year old with a unstable mental health and is seeing someone for it. She is unhappy at her dads and wants to come home but he is forcing her to stay against her will.

It would appear from your question that Dad has some custody right to the 12 year old. If he does, you need to seek relief from a court to change that custody order.
