Legal Question in Family Law in Illinois

My 15yr. old daughter was sexually assulted by her stepdad. He is been arrested and since bonded out. My daughter has come to stay with me,but her mother has custody. And of course he's not to be around either one of my daughters.But my ex hasn't as of yet ,had him around,but is still seeing and talking to him.So of course I'm really concerned! My oldest wants to stay living with me,so i'm trying tofind out what my chances are of getting custody.Macon County,Illinois

You need to go back to your divorce lawyer or find one if you were pro se and go back to court asap, or go back to court -- ASAP. Whether you are successful or not is less important than you TRY. A court may order the stepdad out depending on the divorce decree or marital settlement agreement, or may agree to a change in custody temporarily, but you need someone who can try as soon as possible - the longer you let the situation go the less important it would seem to be. GOOD LUCK - this is terrible!!!
