Legal Question in Family Law in Illinois

adequacy of service of petition

I teach in Germany and my husband in Kendall Co. has told me he has filed a petition for dissolution of marriage. His attorney emailed me an undated, unsigned copy of the petition. Is this proper service?

No this is not proper service. What the attorney is probably trying to do is to see if you agree with the terms. In that case the arrangements could be such that they would not have to do proper service. Please contact me if you would like to discuss this further.

No this is not proper service unless you agreed to accept service via email. You should get an attorney to help you weigh your options and negotiate a divorce agreement without a nasty court battle.

Are there any minor children involved? Do you want any alimony? Does your husband? Please feel free to give us a call if you want to talk about this in more detail.
