Legal Question in Family Law in Illinois
Adoption
My husband is adopting my daughter, but the judge said we both have to petition the court. Why do I have to petition to adopt my own child? What if the judge denies the petition?

Re: Adoption
Generally speaking, when a child is adopted, that means that the "previous parents" lose all of their rights. The exception to this is when one parent wants her spouse to adopt (your case). Both of your names are going on the petition so that both of you are still legally parents after the adoption goes through.
As far as denying the petition, if you are concerned you should retain an attorney. Call our offices if you are interested in talking about your case.
