Do my brother and I , in our 40's and 50's, have any legal say in what happens to our 85 year old dad? We live 1200 miles away, and he has had some strokes and is frail, and yet our step mother, who is 15 years younger than him, is making decisions, doing things that our dad would never let happen. She won't even let him come home from the hospital, putting him right into a nursing home. She goes away for the weekend without telling us and then calls us to come home, when the hospital calls her and makes her come home. When he had the stroke, she never even took him to the hospital. We are frustrated beyond belief.

Certainly you have rights, but you have to assert them. They do not nataurally flow out to 1200 miles. You would likely have to file a suit for guardianship and then be prepared to assume the obligations that go with your assertion of rights.
