Legal Question in Family Law in Illinois
advice needed
my ex-husband lives with his parents, works nights and goes to school on the weekends. he wants joint custody of the kids and wants more time with them.. the children stay with me @ my parents home and have a stable enviroment. I take them to school and then go to work, my brother picks them up and I get home @ 5:30. I help them with their homework and I am there if they need me.. he wants to have the kids there with him more time, but I believe he has no time with them because of his schedule... please advice.

Well, any decent person should have joint legal custody of their children. As far as "best interest of the child" standard, if he does a good job caring for them, the court will allow him to have them for some period of time. It is common to have them with the non custodial parent every other weekend and one night per week.
