Does it affect your divorce case who files and is served first besides being the petitioner or respondent and how?

The primary difference is that the petitioner is the one who is supposed to claim AND PROVE grounds for the dissolution. LIke it or not, dissolutions are part of our "adversarial" system no matter how "amicable" they may appear. There are couples who agree on everything up front and let one proceed with the other basically defaulting. Others are situations where one has an axe to grind, so to speak, or needs immediate court action. There are others but until the facts and circumstances of your marriage are discussed, it is hard to say what other reasons there may be.
