Legal Question in Family Law in Illinois

The affect of a drug conviction on child custody

In 50/50 custody, if the mother who is the custodial parent has recently been convicted of felony drug charges, is there a good chance that the father would be able to switch the custody so that he is the custodial parent?

I believe that the conviction would constitute a signifiacant change in circumstances which would warrant a change of residential custody. However if it did not and will not affect the child, you have a hard fight to change the custody.

I work on these types of cases. Call me for a free consultation.
