Affidavit

I sent my wife, who resided in another state and urged me to do so, an affidavit basically stating tht I will not merge my military retirement pay and any possible future government pension, nor take any action s as to defeat her right to share in monthly retreent benefit as set forth in this aggreement. I also stated that I guarantee and agree to indeminfy against any breach and hold her harmless etc. My question is this, can the affidavit expire? can I revoke it? Is there a statue of limitation? She is now seeking a divorse and I feel helpless.

Hello. In my opinion, the affidavit

is not a binding agreement since there

appears to have been no consideration.

In other words, there was no promise

for a promise; only a promise by you.

However, for future reference, I would

be careful about making a statement in

writing, unless you consult an attor-

ney. You certainly need representa-

tion. Of course, I have no idea of

your assets and whether you have any

children, but all of these issues can

surface in court. I will be happy to

answer any additional questions that

you may have.
