Legal Question in Family Law in Illinois

Age of child

In Illinois what age do you have to be to move out of parents home, or in this case form one parents home to another without the big cutody battle? My son will be 17 in Feb. and wants to live with me, unfortunatley I can not afford a legal battle. I also live in Missouri and they live in Illinois. I have a 14 year old son with this same mother that up until last August I had custody of but because I couldn't afford mediation I just signed the papers. My older son has been showing an interest in living with me and I was just hoping that maybe at 17 he could move without eeven needing his mothers permission anyhow I would greatly appreciate any info. or guidance you can give me.

needs to be 18 unless you have a court order or ex-wife's consent
