Legal Question in Family Law in Illinois

Alienation of Affections

My boyfriend is going through a divorce and his soon to be ex-wife is threatening to sue me for Alienation of Affections. We did not start dating until after the divorce was long filed. Can you sue someone for Alienation of Affections if you begin dating after they've filed for divorce?

She Can sue you, but she would have to prove her case. Even if she did, there is not much she can collect in damages.

You can sue someone for anything. Whether it is dismissed early on is another thing. You will have to establish when the relationship started, she will argue it was earlier, etc. Since it depends on facts of the case, the case will likely go forward.
