Legal Question in Family Law in Illinois

alimony

I have just found out that my Mother, who is disabled, living in subizided housing, food stamps, medicade,et. Should be receiving Alimony payments from her ex-husband.She lives in New Mexico, He lives in Texas, I live in Arkansas and the divorce (over 30 Years ago)was in Illinois. My question: Is there anyway of getting Her Ex-husband declared in comtempt of court and forced to pay the back alimony? I have asked her and she tells me she is not intrested in the back payments. She is has a mental illness hence my Power of A. Divorce took place in Peoria, Il.

Does the attorney(s) get a finders fee? 30 years of back payments would be a hefty ammount.

Re: alimony

To begin with you have to look at the divorce decree and what is says about alimony. I doubt very much that the alimony was to be paid for all these years. Furthermore there is a statute of limitations issue that would prohibit going after very old past due alimony.

Again the first thing you need to do is to see the 30 year old divorce decree and see what is says.
