Legal Question in Family Law in Illinois

Alleged Father's rights

I got pregnant by a man 4 years ago and he disappeared. This man was not my husband. I am still married and now this man wants visitations to a child he never knew.

Does he have any rights in the state of Illinois

Re: Alleged Father's rights

Typically, the law in Illinois presumes that the child born during a marriage is the child of the husband. There are specific time periods for a putative father to contest that presumption, but it requires court action to order appropriate testing to confirm father hood, and then further court action to order both visitation and support. Without such action, the man has no rights.
