Hello, I have attempt to go file for divorce as a pro se at the Daley Center in Cook County and I need a lot of help understanding what to do. I attempted to get the fees waives and the judge denied or refuse to sign off on the fee waiver because as far as she was concern I was not under the "poverty line", which I found interesting granted I'm basically on a fixed income taking care of my 3 children and self w/ $41,000 (no child support). She did not verify my income or my monthly expenses, which results to me not having any additional income to assist with this matter. My series of questions are...is it possible to get an appeal regarding the fee waiver....how can I get all the divorce fees waived, granted I have not lived with my husband since 9/06 and honestly do not know his whereabouts to get him served or anything else for that matter and he has not worked since 1/04. Greatly appreciate your return response in advance!!

Dear Madam, It is likely that some attorney will accept your case with a written fee agreement allowing you to pay a fee over time. If this really isn't in your budget, try contacting Chicago Kent's legal clinic at 312-906-5050.
You are above the income guidelines. They will never waive the filing fees. I f you do not know where he is, how do you know he is not employed. You will have to pay the filing fees, if you choose to represent yourself. Go to the 30th floor for assistance any morning, or, as my colleague states, look for an attorney.
