Legal Question in Family Law in Illinois

Baby Names

I am with my girlfriend and we are having a baby. She refuses to name the baby if it is a boy my first name. If we can not decide then what happens? Or who wins? Can we take this to court? What are my rights as the father?

I don't think it would be worth it to go to court over naming the baby, you have rights as a father, but it is a good idea to get them legally recognized (first by signing a voluntary acknowledgment of paternity). Maybe the two of you can reach a compromise? If for some reason you decided to go to court over this, you'd be ordered to go to mediation, keep that in mind.

If you and her are having disputes then I suggest you file a paternity action immediately so that this issue can be addressed prior to delivery of the child. This assumes she identifies you as the father. If she will not do this there is a chance the court will not address the issue until DNA tets are taken to determine if you are the father or not. File your court action immediately.
