Legal Question in Family Law in Illinois

back child support

Am I entitled to back child support for my children, now ages 20 and 22, when no child support was ever paid for them and they were 18 months old and four years old at the time that I was divorced? However there was never a court oder for child support. Not because I did not need it. Only because I did not have the resources to hire a attorney. Please let me know if I have a case.I have a child in college that could use the money.

Re: back child support

Based on the facts given, you have no claim to support because there is no support order to enforce. There may be special circumstances due to the divorce, if the father abandoned the home and children, if the court order implies child support (parents are obligated to support even if the court order does not specify), if you can show you asked for support but was refused, if he then or now earns sufficient income to pay support, including college expenses, etc., but you are advised to consult a local family law attorney to discuss options.
