Legal Question in Family Law in Illinois
A little background, divorced with 2 children. Papers state no custodial parent. A mediator who happened to be a lawyer has even pointed it out during mediation once. Our current schedule rotates around their mothers work schedule. She is a nurse and can arrange her work schedule from what I remember. Currently I am working mon-fri 8-4 but at the end of the year be going onto 12 hr shifts. I am a police officer. I will work mon/tue/ fri/sat/sun then wed/thur the next week.
I'd love to try an actual set schedule but she has denied the idea probably 5 times when I've brought it up before. Currently I receive a schedule 2 weeks in advance to find out when I have the children for the next few weeks. I currently have visitation every other weekend and 2 overnights a week unless she takes days off. But I am guaranteed 1 overnight during the week.
My question is, how can I try to get a set schedule for the children? They mention their confusion to me because their mothers schedule is different all the time. No rhyme or reason. I understand a nurses schedule may be crazy but why not have a set schedule and she can find a babysitter just like my wife/their stepmom, keeps them on my time when I can't be home because of work.
Again there is no custodial parent listed and split custody but somehow she still makes all the decisions.

You need a Court Order that addresses all of these issues. You should hire an attorney to help you.
