Birth and surname
Can a child born to unmarried parents have the father's name on the birth certificate, or does the child always get the mother's name?

Yes. The child can have the
father's last name even if
the parents are not married.
However, it is important to
know that under Illinois law,
the father has no legal rights
until he is legally declared
the biological father pursuant
to a filed parentage petition
to establish the father and
child relationship. Either
the mom or dad can file this
