Legal Question in Family Law in Illinois
My boyfriend is having a hard time dealing with an open adoption issue. He heard a few years ago that his friend was pregnant with his child, and of course he didn't believe it. The next time he heard from her wasn't until after she signed the open adoption papers. He says he legally has no rights to see the child since he wasn't on the open adoption papers, so he has to go through the birth mother on her visitations to see the child. Is there anything he can do now to get onto the open adoption and get his own legal rights to see the child?

He has a right to register as a putative father when he found out she was pregnant. His failure to register timely may have waived any claim he might have. It is a very fact specific issue that has to be analysed to see if he may have rights which were ignore, or that by his inaction he waived those rights.
