if me and my ex boyfriend have a son and never been to court for any kind of custody and i did not give the child his last name and i let him take the child for a couple of days and he wants to keep him longer can i get him in trouble?

First, why would you want to get him in trouble for asking to keep the child longer? I suggest you hire an attorney, lay out all the rights, responsibilities, visitation time, child support and so on in a legal document to protect everyone and then work on being polite friends who have to raise a child together.
