Legal Question in Family Law in Illinois

Breach of promise to marry

I've been engaged for 5 yrs. my fiance retired and asked me to move with him to a new house and community. I sold my house, left my job and family and did just that, assured we would be married and I would be covered with all the securities one enjoys as a wife. That was 4 years ago. I am unemployed and uninsured and marriage does not appear to be in the future. I'm 52 yrs.old and contemplating starting over with a new job and hopefully benefits. I live in a very small, rural conmunity with very limited job prospects and would likely want to relocate. Would I be entitled to any monetary support to be able to start over and heal from a large disappointment? Thankyou

Re: Breach of promise to marry

There is some basis for recovery. As you say "breach of a promise to marry" is the case of action, and the best arguments you can make are that you quit your job, incurred moving expenses, etc in reliance on the promise of marriage.

As far as the emotional dissapointment, I doubt you will have any success on that count.

Your recovery would come in the form of damages (for example, to pay for the moving expenses) and not in the form of support. Without a marriage, there is no alimony obligation.
