Legal Question in Family Law in Illinois
What are my chances?
I was wondering if my ex girlfriend can keep me from my son. I do admit I did some pretty stupid things in the past and I have not given her any money. Mainly because she won't accept it from me. But I never really worked and if I did I really didn't have enough to give. I have a daughter that I get child support taken out of my check and I don't see her.. And I am now in the army and have a better outlook on life. I am married now with two more children. Will that have any affect on me? My ex is getting married and wants her fiancee to adopt my son but I won't allow it. And she is madder than ever. Is there anything she can do to overturn my decision even though I haven't been doing anything to support him? If she took me to court for child support would she be granted even though she wouldn't take any money from me? If she were to file for sole custody, what would her chances be?

Re: What are my chances?
Hello. You will only have rights to your son, if
you have been legally declared the father. If not, you should immediately file a Petition to
Determine a Father/Child relationship. In other
words, your ex-girlfriend will have an easy time
keeping you from seeing your child, unless you
have been legally declared the father. Also,
your ex-girlfriend's has a chance at
getting your child adopted by her husband, unless
you act quickly and get the "parentage petition"
on file. I will be happy to answer any additional questions that you might have.
