Legal Question in Family Law in Illinois

Last name change

I have an 8 yr old son by a previous relationship. He has my last name. I recently got married to someone who also has a son. My son is now the only one with a different last name and wants to know if we can change it. He does see his father every other weekend and I don't believe he would let my husband adopt him. Is there any other way to either change his last name or hyphenate it??

Re: Last name change

Greetings -

Because of your son's young age, dad would have

to consent to the change of name, assuming dad

has legally been declared the biological father.

However, a petition should be filed in court anyway to start the ball rolling. Who knows?!

Dad may agree to the change of name, but the

court would probably also have to be satisfied

and a court appointed guardian ad litem to

serve as your son's would be selected by the

court. You need representation. I would not

suggests that you should attempt to represent yourself. I will be happy to answer any additional questions that you might have. There

is a three step solution to your case.
