changing birth certificate

9 month old baby had name changed to mother's new husband's name - he is not the blood father. Now divorcing. Is there any way to change the baby's name back to mothers maiden name. Married less then 1 year and he spent 6 weeks with the child. Husband not interested in visitation and doesn't want to pay child support on child that is not his. Mother agrees to this.
