Legal Question in Family Law in Illinois

Child Custody/ Abandonment

A friend of mine has one son with his ex and another that he's raised with her but wasn't his. Several weeks ago he returned home and found she had left him for someone else and both kids were left in the house. He immediately filed child abandonment on her and her wages are being garnished for child support. My question is, in this situation is there any reason to worry about the mother trying to regain custody of the child that was not his even though he's raised it? My understanding is the bio father was never in the picture. I don't know if my friend is on the birth certificate though. The children are 3 and 4.

Re: Child Custody/ Abandonment

Your friend must file in court for guardianship of the chil;d that is not his, and custody for his own child. Please have your friend call so we may discuss this.
