Legal Question in Family Law in Illinois

child custody

my daughter is not maried & the father of her children & her have been living together. They have decided to leave each other. My daughter is concern that he will take the children from the babysitters while she is at work. What rights does she have in a case like this?

Re: child custody

Until your daughter gets a court to lay out who the residential parent is, and everyones responsibilities/rights, the child is in a sort of limbo. It is important to get things legally determined early on, to prevent problems like the one you mention. For example, if the father is not allowed to take the child from day care, and he does it anyway, then the court will step in and punish him, take away other rights etc. If its an informal agreement between the parents, there is nothing one parent can do if the other breaks their part of the deal.
