Legal Question in Family Law in Illinois

child custody

I am just inquiring about a problem I am having with my sons father. We went to court about 9 years ago and we were granted joint custody for my son. 3 and a half days each. Recently the father just told me that because of past problems I have had with drugs and the law that I can only see my son every other weekend. I know legally I am allowed to see him with the origanal court agreement. What I want to know is, is it worth it to take him to court over this matter. I am worried that he will fight for full custody, and with my past I will lose. So is it just worth it to deal with his offer? Or should I try and find a lawyer and persue this to have him honor the original agreement.

Re: child custody

One of the things about accusing someone of drug abuse is that the accuser has to prove it. Unless you have a criminal record for drugs, and or he has had a chemical analysis of the alleged drugs you were using, its hard to prove. He is, in fact, in violation of the court order. Besides, he'd have to prove that your son was in danger while he was with you. Or that it's in the best interest of the child that he retain custody. Stand up for your rights. Hire a lawyer and go after this guy. He's the one in contempt of the court order. Please call for further discussion.
