Legal Question in Family Law in Illinois

Child Custody

What if there is no child custody order between the parents and one parent wants to give full custody to the other parent - does this need to be done legally? Do both parents have to be in agreement? How does this work?

Re: Child Custody

Of course there needs to be an order entered! It is not only up to the parents. The court has to find that it is in the best interest of the child. Both parents do not have to be in agreement (and rarely are). How it works is a hard question, since I do not know the facts of your case. Feel free to provide more information.
