Legal Question in Family Law in Illinois

need help with child custody questions

my husband and his ex girlfriend have a 5 year old together. they have joint custody, but she has primary residence. at the time we were all living in florida whe it was decided in court. she has sinced moved to massachusetts and us to illinois. my husband picks up his son once a month for visitation for 8 days. she is now keeping my husband from his visitation and we want to seek primary residential custody. do we use illinois law, massachusetts law or florida? we have a very stable loving family and he has a sister here as well. he loves being with us and would be much better off with us. do you think that it is likely that we could win this battle? thank you.

Hello and happy holidays! It would be great if

you could bring the case here in Illinois, but

unfortunately Florida is where you must go. At

least in the beginning. The problem is that the

child is in Massachusetts, but this may not be

a problem. If you can keep it in Florida where

there is a history of the matter, at least on

paper, the visitation issue can be handled more

efficiently. Now as to custody; that's another

issue. I suggests taking it a step at a time,

but your husband should start on this right
