Legal Question in Family Law in Illinois

Child Custody

My questions pertains to my five year old son. I have been divorced for about 1 1/2 years now, since then i have remarried. I have been married for 1 year now. I have custody of my son from my ex wife. she does drugs, she has admitted to this she is supposed to pay $100.00 a month for child support, she does not. As far at that goes she is on social security for a mental disability, she can work but chooses not to so she doesn't have to pay child support . Since it's a government check there is nothing i can do.

Everytime i let her take him for the weekend he comes home he does strange things. For one i think her and her boyfriend might do some sort of sexual acts in his sight. I would like to find out if my wife can adopt my son.

Re: Child Custody

You can use the Child Support Enforcement Agency to help get the child support in arrears. If she is getting SS payments the child might also be eligible for payments (probably more than the child support). Check with Social Security on this. Ask you ex if she would be willing to let your wife adopt and explain that if adopted she would not be liable for child support anymore. Hire an attorney.
