Legal Question in Family Law in Illinois

Child custody

My son and i live in illinois. Recently the donor (which is my son's father) had a lawyer which is one of our mutal friends from utah send me a friendly letter trying to work out rights for my son. The donor lives in utah and i'm not sure if he is a citizen or not. Would he have to get a lawyer from illinois and come out this way if he preceeded to take me to court?
