Legal Question in Family Law in Illinois

Child Custody

My son will be 15 at the end of the month. He currently lives with his father in Michigan. There have been some problems, and he wants to come live with me. What is the legal age for a child to decide who he wants to live with in Illinois? How do I go about getting him moved here and legal custody? Thank you for your time.

Re: Child Custody

18 would be the legal age. Prior to that it is what is in the best interest of the child. At 15 he would have some input.

Re: Child Custody

There is no age (until he is 18 of course) that a child gets to decide who to live with. It all depends on the best interest of the child in IL, and in many states. If your divorce was entered in MI, and he is living there, then you must bring in action to modify custody in MI (assuming that there is a current order by the court relating to custody).
