Legal Question in Family Law in Illinois

Child Custody and Support

My ex-wife and I have Joint custody in

Illinois. She wants to move back to New

York. Is there a law against her leaving

the state with my daughter, and if there is

and I give her my consent and we agree

that she will not raise my child support,

can I get the no raise of child support in

legal documentation in court. If so, can

New York law override a court order of

no more raise in child support in the

future?

Re: Child Custody and Support

She can leave the state for short periods but not for good without the court's blessing. You two CANNOT agree as to child support going up or down, since the court will ONLY take the best interest of the child into account. New York will not have jurisdiction over this matter (at least given the facts you presented).
