Legal Question in Family Law in Illinois

Child Custody & Support

Hi, I am a unmarried mother of a 13 year old. I Had to go on public aid and the state of illinois went after Dad for child support. he has established paternity on our 1st court date. He has petitioned for Joint Custody? Can he really get Joint Custody in Illinois? We have never been to court ever over our child, there was never a court order for visitation or support? Will I be able to get 13 years back support if I kept my child away from him and moved without telling him? So my questions are Does he have a good chance of Joint Custody in Illinois? What are my chances of 13 years back child support? Thanks.

Re: Child Custody & Support

Hello. Dad will be unable to get joint custody

(joint parenting), if you do not agree to it.

Joint custody/parenting is awarded by the court

when the parties have a written agreement to that

effect. This has been my experience with this issue. In my opinion you have a good chance at

getting the 13 years of child support that dad did not pay. I will be happy to answer any

additional questions that you may have.
