my son is incarcerated, he was established as a parent through dna, the child was taken from the mother because drugs were found in babys system what are his rights as the father and mine as a grandparent? He will be out in august

He is still the father and has an edge as to who should be the residential parent. It does depend on what he is in jail for, and the best interest of the child. Before the son loses the right to have the child, the court must find he is unfit.
