Legal Question in Family Law in Illinois

Should My Child Have To Live Where He Does Not Want To?

My child lived with from when he was born until he was twelve. There was joint custudy, and he went to his fathers house on the weekends. About 2 years ago, his father sued for joint custudy to live with him. My son now lives there, and he comes to my house on the weekends. Whenever he comes to my mouse, he tells me about how much he hates living with his stepmother and father. Their practices even seem strange to me. Since he is now fourteen, I understand that he has a say in where he lives. I want my son to come and live with me, but I know his father will fight it. What do you think I should do?

Re: Should My Child Have To Live Where He Does Not Want To?

Since your son is 14 the judge will take your son's desire to live with you into consideration when deciding the issue. If you really want your son to live with you and he really wants to for valid reasons then you are going to have to bring the matter back to court, present evidence and let the judge decide.
