Legal Question in Family Law in Illinois

child paternity

I wondered if I was to take the father of my child to court to prove paternity, would he be responsible to pay for the court costs if he was proven to be the father or would I be responsible or it?

Re: child paternity

Hello. Your child's father can be made to pay

attorney's fees and costs, such as the costs of

the DNA test, assuming he is not excluded from

the test. However, in many instances this is

up to the court based upon your income and your

child's needs. If dad decides to ask for a DNA

test, the court will usually assess the costs

against him; the cost of your test, the child's

test and his test. If for some reason the DNA

test concludes that he cannot be the father, the

court might order you to pay the costs of the DNA

test. I will be happy to answer any additional

questions that you might have.
