child removal

My wife and I are planning to move out of the state (illinois). We want to move to Oklahoma. My wife has 3 children with her ex-husband. She has full custody. What exactly do we have to do to be able to move the children? Do we have to go to court? If the non-custodial father says it is ok do we still have to go to court?

Hello. It is necessary for your wife to file a motion to remove the children to another state. This is required since the father's visitation rights will be affected. The court will hold a hearing to determine whether it will allow removal of the children. Will be happy to discuss this matter further and in more detail.
