Legal Question in Family Law in Illinois

Child Support Calculation - 2nd opinion needed

I'm looking to get a 2nd opinion on how child support is calculated in Illinois. My attorney has told me that it's 20% of the difference of mine and my ex's net income. Everything I've read is that it should be a straight 20% of my net income only. My attorney is a family law attorney that's in court every day. Is it possible that I would only be liable for the 20% of the difference. How?

We separated last November. There is currently no ruling. We just have a verbal agreement as to what I am paying.

Any attorney that told you it is the difference of you and your spouses income multiplied by 20% is a moron, or lying about being a family lawyer in IL. That is completely incorrect. It is 20% of your net income, PERIOD.

Do not use an attorney that doesn't even know the basic child support laws in IL!

In Illinois the default is for the non-custodial parent to pay 20% of their income for child support. If you have any other questions please contact my office.
