% of child support

I have two children, make $350.00 per week, the state has taken all but $30.00 of my paycheck for child support. What is the procedure to get this amount reduced?

Child support is based primarily upon the obligor�s net income from all sources, and the recommended amount of support for two children is 25% of net income. Your support obligation appears to be more than 90%. If this is a case where the Illinois Department of Public Aid is collecting the support amount, you should notify them immediately of your employment and income, and you should be prepared to prove your net income figure. The Department MIGHT agree to modify support.

Your other choice is to file a Petition to Modify Child Support and prove your case to a judge. Although a layperson may have the ability to prepare pleadings, obtain a court date, file and serve pleadings and notice, and proceed through discovery to the hearing to modify support, having a lawyer�s help or representation would certainly make this easier.
