Legal Question in Family Law in Illinois

child support for child in college

I have a 19yr. old daughter that is attending college. Her father was still paying child support until now when he petitioned the court to have it stop. He has not paid for anything else besides the support. Will I have to pay him back all the child support since she turned 18 and then take him back to court to help pay for her college education?

Re: child support for child in college

Almost surely not although I need more information than you've given. A child turning 18 usually isn't the child support cutoff time...more often it's when a child graduates high school. The only possible time that a court might order you to reimburse the father would be for the time after which he filed his Motion to Terminate Support unitl support was actually terminated...likely no more than one month or so...this would only be the case if child support were being withheld from father's employer.

As for college...yes, you need to petition court if he won't do it voluntarily. This is a separate issue. It's fairly simple, court's going to look at the property/income of the two parents at the time of child going into college and the expenses will be divided.
