Legal Question in Family Law in Illinois

My father has child support coming out of his check automatically in Cook Co, IL. My sister dropped out 3 years ago & left home. She will be 20 years old next month & the payments still come out. He can't get them to provide proof of education. How can he get the garnish stopped? I believe my ex-stepmother is guilty of theft by deception or fraud for knowingly receiving payments that were not owed to her. How hard is that to prove? How hard is it to get the fraudulent support returned? By the way, my father paid an attorney $1400 up front 6 months ago to get this resolved & can't get him to return his phone calls to update his status. My father is very nonconfrontational. I am not. I want to know if I have any rights on my 60 year old father's behalf. Could I file a complaint of theft with the police on his behalf? I know that this is a long & complicated question, but I would greatly appreciate your advice & help. My kids want their grandpa back & this is depressing him greatly as he feels unrepresented by our legal system! Thanks in advance!!!

I do not see any theft or illegal activity in this matter, so lets put that aside. You need to get a (good) attorney to step in and get the withholding to stop. Make sure to use a family attorney who does only this type of law, can give you referrals, and states upfront when things will be filed, accomplished, etc. IF you have more questions, feel free to call my office.
